SPEEDING at 3am is stupid.

But isn't it safer and more appropriate.... there are less cars on the road, so the conditions are more favorable.... but you'll be more easily singled out by cops.

 

He must have left the bars at 3... been stopped... then arrested at 3:40.....

No, he broke at least one law and got caught. Well, two laws... one was speeding, the other was common sense. Both could end up being very expensive.

Common sense is a law?

Many, many people out there breaking that one ...

Don't forget weaving across lanes.

 

Oh, maybe that was the second law.

If he broke the second law of motion, I'd be more impressed.

He has 10 days to "protect" his license, or else it gets suspended  for 12 months, if this is his first refusal

Here's what I was thinking - it's called "Implied Consent" - but it looks like it's far better to refuse than to allow. But as Rick just said, it's far, FAR better to not drive after drinking. Mathies probably needs to be fired for being a bad example, unless he apologizes profusely, then signs up at AA, detoxes, and becomes a complete teetotaller.

Florida's Implied Consent Warning

In order for the fact that the driver refused to submit to chemical testing to be admissible at trial, the evidence must show that the officer advised the driver of Florida's implied consent warnings. The implied consent laws require that any driver who accepts the privilege of driving a vehicle within the state is deemed to have given consent to submit to an approved chemical test of the driver's breath, urine or blood.

The implied consent warnings in Florida require the arresting officer to tell the person that failing to submit to testing could result in an administrative suspension for six (6) months for a first offense, and eighteen (18) months for a second or subsequent suspension.

Section 316.1932(1)(a)1.a, Florida Statutes (2007), provides in pertinent part:

In many refusal cases, the prosecutor is left without any evidence of the driver's blood or breath alcohol concentration. The DUI defense attorney is often fighting to force the prosecutor to drop the charge from DUI to reckless driving. Statistics reported by the DHSMV show that DUI cases involving a refusal are reduced to reckless driving more often than DUI cases involving a breath test reading.

Any person who accepts the privilege extended by the laws of this state of operating a motor vehicle within this state is, by so operating such vehicle, deemed to have given his or her consent to submit to an approved chemical test or physical test.... The chemical or physical breath test must be incidental to a lawful arrest and administered at the request of a law enforcement officer who has reason to believe such person was driving or was in actual physical control of the motor vehicle within this state while under the influence of alcoholic beverages....

Dumb, selfish thing to do. He at least had reason before he started throwin' em down. His penance should be equally public, but I'd be a little surprised if he gets fired.

I'd argue that some could see it as a mistake.  If a guy is sober and you ask him if he would drink and drive he would tell you no way. Problem comes when you have been drinking and don't realize you are impaired and then go out and drive.  It is a mistake in judgment caused by the impairment. Doesn't necessarily make you a bad guy.

Not to get too technical but mistake perfectly describes what he did. Some mistakes just have bigger consequesnces than others ...

People seem to take such a arrogant snub-nosed approach when it comes to DUI's. If you are a drinker, there was probably some point in your life that you drove when you probably shouldn't have. Some people get caught and some don't. Getting caught doesn't make you a bad person. It's an exhibition of bad judgement caused by reduced inhibitions. People need to get off their white horses because I'm sure they are not perfect all the time either...
