IMO the charges will be dropped or plead down due to a lack of evidence

Well that is the cops story.

He refused breathalyzer and a sobriety test. There is not film to show him stumbling... Maybe there is a dash cam showing him weaving or some audio. The article does not mention any containers found in his vehicle.

At this time, aside from the testimony of the police officer, there is no evidence for anything except possibly speeding and weaving. If he remains silent, doesn't admit to any drinks, they shouldn't have a case for the DUI charge. People speed and weave all of time without the influence of alcohol.
