NCAA, after review, will go forth with Miami investigation, but is that fair?

But the Miami situation specifically is a mess. No matter that the NCAA thinks it has fixed the issue and can go on in this case like nothing happened, there will probably be no satisfactory outcome in the Hurricanes investigation. The only thing left to determine is who will be most upset when it's done.

Miami administration and staff turned a blind eye to what the players were doing because it worked for them.

Miami is going to get hit with more penalties, how severe, who knows? Miami fans and Shalala are delusional to think they can self impose penalties on yourself and you're good to go. They were OFFENDERS...how often do offenders control their punishments? They don't and shouldn't be able to when in a severe case like this. This isn't free shoes or a dinner or something small.

The
University of Louisville confirmed that defensive line coach and
recruiting coordinator Clint Hurtt received a notice of allegations from
the NCAA detailing alleged violations that occurred during his time on
the University of Miami staff.

The
Associated Press is reporting via a source that Hurtt is one of three
former Miami staffers being charged with unethical conduct by the NCAA.

The
AP said that the NCAA believes that Hurtt, Aubrey Hill and Jorge
Fernandez provided false or misleading information during the probe into
the Hurricanes’ athletic department.

Hurtt,
who has been at U of L since head coach Charlie Strong took over in
2010, has 90 days to respond to the notice, and that would lead to a
formal hearing that would likely take place sometime between June and
August.

If Hurtt
is found guilty of the allegations, his status on the Cards’ staff could
be in jeopardy. He would likely face a show-cause penalty, which means
despite the fact that none of the violations happened at U of L Hurtt
would still be subject to discipline for whatever length of time the
NCAA deemed necessary.

The
investigation also included Miami’s basketball team. Former coach Frank
Haith, who is now head coach at Missouri, also received a letter but
was charged with “failure to promote an atmosphere of complianceâ€
instead of the more serious unethical conduct charge.

Jake
Morton, a former UM assistant who is now the director of basketball
operations at Western Kentucky, also received notice from the NCAA.

The
charges against Hurtt stem from an August 2011 Yahoo! Sports
investigation into rogue booster Nevin Shapiro’s ties to the Hurricanes’
football and basketball programs. Shapiro, a convicted felon currently
in prison for his role in a multimillion-dollar Ponzi scheme, confessed
to giving impermissible benefits to Canes’ recruits and players from
2002 to 2010.

Shapiro
implicated Hurtt when he said that he gave Hurtt a $5,000 interest-free
loan that — despite being paid back — was also an NCAA violation.
Shapiro also alleged that he arranged for Hurtt to bring recruits to his
mansion and that he paid a restaurant tab on a recruiting visit.

The
NCAA investigation hit a roadblock when it was revealed members of its
investigative staff paid Shapiro's attorney to help depose witnesses. It
led to the firing of the NCAA vice president of enforcement Julie Roe
Lach, and the NCAA had an outside source launch an investigation into
how it handled the matter.
