Its a means of sharing risk across the 2 parties, lest one (employer) get 100% participation in potential upside while the employee gets 100% participation in the downside. A buyout means if something goes wrong, we are both on the hook. Its basic risk management, probably in any decent mid-level business courses, and absolutely in everyday business contracts - renters, read your leases. I bet you will pay a penalty to break early (a buyout! You "fired" your lessor). Also to criticize contracts signed years ago with information NOW about the effects of covid on school budgets, that's just intellectually dishonest. Yes the number is shockingly high... now that we know budgets are hurting. This article would be a nonissue last year. TLDR- the article is wrong at worst, and right for the wrong reasons at best. A typical lease for a renter is one year and the buyout is a fraction of the months or until another renter is found depending on the clause you select. You are right an equality of a buyout would make sense but at current what is given is an unconscionably inequality of risk that is the exact opposite of what you describe would happen. Most schools buyout clause is the entirety of the contract and most coaches buyout clause is less than a small portion of one year of their pay. You should know by now that college football does not operate within the cannon of ethical thought...it is exclusively tied to the economic concepts of Adam Smith with little regard for fairness and common sense.
