Several different things happening legally. 

Fines arising out of HIPAA violations would be against the hospital and paid to the feds.  Similar for any violation of state law and civil penalties.

 

There may be criminal penalties against the specific individual or individuals who leaked the information.

 

As for JPP, he could have a claim for damages against the hospital and whoever leaked the information, but he would have to show that he suffered damages. Given that the Giants rescinded their tender before the disclosure that may not be a slam dunk.

So where do you practice? This borders being too official for our little board... ;)

The Health Insurance Portability and Accountability Act (better known as HIPAA) forbids anyone working at a hospital from sharing a patient's record, and now Jackson is aggressively trying to find out of if any of its employees violated the law. 

 

"Late Wednesday, media reports surfaced purportedly showing a Jackson Memorial Hospital patient's protected health information, suggesting it was leaked by an employee. An aggressive internal investigation looking into these allegations is underway," Carlos A. Migoya, president and chief executive officer of Jackson Health System, said in a release, according to Local 10. "If these allegations prove to be true, I know the entire Jackson family will share my anguish."

 

"If we confirm Jackson employees or physicians violated a patient's legal right to privacy, they will be held accountable, up to and including possible termination," Migoya said. "We do not tolerate violations of this kind.""

I thought Florida Fireworks Statute 791 says it's illegal to have fireworks like JPP was probably using.  Apparently law isn't really enforced in Florida and everyone looks the other way.  I think the fireworks sellers in Florida use an exception clause in statute that allow fireworks for agricultural use to scare birds away in crop fields and what sellers do is get buyers to sign a release form that that is what they are using the fireworks mortars for...not for shooting out of backyard for recreation.  Dumb.
