As with most things NIL-related, not so black and white.  I suspect this will evolve rapidly along with everything else in the universe.

The nil rules are all over the place. Some schools get punished and some good a slap on the wrist. The nil has ruined college football and the whole student athelete thing. Judges ruled against the ncaa and we have schools having players unionizing even though they are terrible at their sport Dartmouth basketball if memories is correct.

I don't think this is a NIL issue, as a simple legal issue. Student visas limit employment off the college campus. 

 

student visas are easier to get than work visas. 

I would think the solution is just to get a different kind of visa (but that does have challenges).
