I say the Big 12 will shock the world and add 4 teams..  They will create 2 divisions of 7 teams each.. Each team will play 6 games in their division, 2 games against other division, and then 4 OOC games. 

 

TCU, TT, IowaST, Kansas, KSU, OK, OK st

Baylor, UT, WVI, Houston, Cincy, ucf, USF

Can ESPN threaten to sue to stop them? Yes, ESPN can threaten to sue. Oh yea, ESPN wrote the contract. But, unless there's wording in that contract based on losing teams, I don't see how they could win.

You're definitely right that it is unlikely that they could win, but it's also extremely unlikely it would ever make it to a point where the could 'win' in court -- I'm sure there are arbitration or mediation clauses. It would just be a way for them to force everyone back to the negotiation table and secure a better deal. That means uncertainty for Big 12. If they add new members based merely on expectations found in clauses in the contract and then ESPN flips the script... they have a mess.

As much as I hate it, they need to make sure their TV partner will play nice with whatever decision they are making unless they're planning to leave ESPN for another company.
