This just might be a guess, the game contract requires each school to have x number of seats available to the other school for each game. With a cut off date to return unused tickets.

 

Now, the next part is not exact, but just my guess. If x = 10,000 ; and Miami exercises their right to hold those tickets to the deadline (even if 8,500 of them will be returned), then we might need both upper decks to fulfill our contractual obligation to Miami.

 

I'm out of the loop, I don't think sales currently dictate both upper decks being open. I have no idea if this is the reason, but it would be a possible logical reason.
