I was doing a little counting last week, I think I counted a couple of weeks ago the fact that UCF is down 30 players year to year counting injuries, players to the NFL, players graduated. This week they get a few important pieces back. I hope to see a win in person this weekend in the Big Easy....bring 8 people with us! Beat Memphis! Do you think O'Leary should have kept his job, or do you only care about winning? The jury at trial tagged UCF Athletic Association (UCFAA) for $10million. The case went up on appeal on the legal issue on whether UCFAA was a state entity entitled to the sovereign immunity cap of $200,000. The 5th District court of appeal found that UCFAA was entitled to sovereign immunity. However, one of the judges on the appellate panel noted “It was both the coaching staff’s actions and inactions that led to the tragic death of Ereck Plancher . . . It is difficult to comprehend how one human being can ignore another in obvious distress or prevent someone else from offering aid to one in distress, but, inexplicably, that is what happened here.”The case then went to the Florida Supreme Court on the same legal issue. The Florida Supreme Court, in a 6-0 decision with one justice abstaining, agreed that UCFAA was sovereign immune. However, the Florida Supreme Court did not overturn the jury award. What it did was cap UCFAA liability at $200,000 but note that the Plancher family was still entitled to pursue a claims bill through the Florida Legislature. A claims bill would basically be the legislature authorizing the settlement of the amount over sovereign immunity with state funds.
