EXCLUSIVE: Family of USF player reacts after Leavitt's firing

Reported by: Alan Cohn

Watch the full story tonight on ABC Action News at 11pm.

TAMPA, FL -- A visibly upset Joel Miller left his New Tampa home this morning with his mother and father for a meeting with USF Administrators.

It's been an uncomfortable time for him ever since he was identified as the member of the USF Bulls who allegedly was grabbed by Head Coach Jim Leavitt around the neck and slapped during half time at a game against Louisville in November.

Friday afternoon Miller's father talked exclusively to ABC Action News.

"He's okay, he's upset.  It's his coach but you know. I'm sure he didn't want this. No he did not," said Miller's father Paul.

Miller denied to investigators the coach did anything wrong during the incident at Raymond James Stadium.

And the coach told investigators all he was "in a concerned and encouraging fashion crouched at eye level because Miller appeared down" after his poor play in the first half.

But in the University's 31-page report eyewitnesses told another story which lead to the school terminating Leavitt's contract and sending him a letter saying "USF is forced to conclude that your statements are not credible given the consistent lack of corroboration and frequent contradiction between your version of events and those credible eyewitnesses."

Joel Miller did not want to talk on camera but his father reacted to the coach's firing.

"Do you think the right think was done?" we asked Miller.

"It's hard to say I don't know. I really can't comment on that. I like Coach Leavitt so it's kind of hard and Joel likes him too and he's a good coach," said Miller.

The Miller family is now getting a lawyer. Why? For legal action against who? Paul miller won't say.

who are they going to sue?  leavitt?  usf?  come on.

i feel bad for joel but he should leave USF.  this will be hanging over his head for the rest of his time at USF if he stays.

Looks like someone's about to cash in. Got to love America.

Unless you're the one being sued.

I'll tell you why, because Judy Genshaft and Doug Wollard just PUBLICLY accused this kid of LYING.  He has clear grounds for a suit against the University.  Wollard and Genshaft were going to fire CJL all along.  They bring the results of this trumped up witch hunt as their reason for not having to pay what they are contractually obligated to do.

I think Genshaft should step down and Mr. Closed door hush hush Woolard fired.  Those two should be under investigation.  I'd bet my ass that where they end up if Leavit and the Millers sue and win.

A university official investigation proved enough for them to claim breach of contract. So basically, Leavitt struck him, and its been proven. He can sue for all the pain and suffering. Leavitt is a millionaire. Would not want to be either Leavitt or Miller right now.

Please rephrase your statement. Not anywhere in the investigation does it say it was proven Leavitt struck him.

Half or less of the people interviewed had totally different accounts of the incident. Steming from the differences in the statements, the investigators concluded that Leavitt struck Miller. But no where does it state that that was 100% proven.

It was just there best outcome of the interviews.

Several said he did, including Miller to students when it first happened. Read the report. When JL started the most powerful man in the building threat, Miller, afraid of losing his scholarship changed his tune. Its like a bad movie of the week. Do you know who OJ Simpson is? Well, take this to trial and see how much dough Miller and his family get out of USF and Leavitt. More then one player who could directly see it said it happened. That will stand up in a court of law. And I am afraid we will see that sometime later this year.

He doesn't  need a lawyer.  Leavitt may wanna get one if he wants some more of that contract he signed, but not the millers.

So what about the other half of the people who saw the whole incident and had a totally different story? Even the freaking head trainer who was 3 feet from Leavitt?
