If this is true, there has to be some kind of tortuous interference here. Additionally, ESPN would not be negotiating in good faith by having such a blatant conflict of interest.

ESPN has proven they don't care. Sue 'em, they'll say.

Why on earth would you make negotiations public? That goes for either side. Negotiating a contract like this and putting anything out in public would be the most idiotic thing I have ever heard of.
