The suit accuses the pawnshop owner of failing to recognize that the man who purchased the gun that killed the officer was doing so illegally. The suit says the shop owner ignored guidelines set but the National Shooting Sports Foundation and failed to ask any questions to the buyer before making the sale. It was there, at Ed's Pawn Shop and Salvage Yard, that the Smith & Wesson pistol used to kill Wortham was purchased. Quawi Gates, a Rust College student in Holly Springs, Miss., who had a gunrunning operation on the side, had asked an acquaintance, Michael Elliott, if he wanted to make some quick cash. Gates' criminal record prevented him from buying guns, so he had lined up several college students to make the purchases for him for $50 to $100 a weapon. Elliott was stressed out over his hospitalized infant daughter and agreed to buy three guns for Gates in return for $100. Wednesday's lawsuit accuses the pawnshop and its owner, Bruce Edward Archer, of failing to follow guidelines established by the gun industry's trade association, the National Shooting Sports Foundation, about how to detect a straw purchaser. The lawsuit claims that during the 2008-2009 season, Boogaard was given "1,021 pills by NHL team doctors and dentists" and he took up to 10 oxycodone a day. Boogaard suffered brain damages from years as an "enforcer" in the league, and the suit says the NHL "knew or should have known" that players with brain damage are at higher risk for drug addiction. The police report says the woman hit the officer with her car and fled with him on the hood while leaving an apartment complex, but witnesses at the scene say the officer jumped on the woman's car to stop her from leaving, and then shot her five times as she tried to reverse and drive away. The suit also claims the agent had a history of disciplinary issues as a sheriff's deputy and should have never been hired.
