Man Kicked Off Plane May File Lawsuit

A Brooklyn man has told the Detroit media that he is considering a lawsuit after he was kicked off a Delta Airlines airplane in Detroit for using the F-word. The man said he was speaking to the passenger sitting next to him during a 45-minute delay on the runway, asking "What the [expletive] is taking so long?" A flight attendant, hearing the curse word, called the police and had the man escorted off the plane. Proctor & Gamble Settle Diaper Class-Action Suit

Proctor & Gamble has agreed to a more-than $3 million settlement in a class-action lawsuit filed over the company's Pampers Dry Max diapers. The lawsuit contended the product "caused diaper rash and other skin problems" in infants and young children. The Consumer Product Safety Commission reviewed the customer complaints and company data and "found no link between the new Pampers and diaper rash," the Cincinnati Enquirer reported.  David Holthaus , The Cincinnati Enquirer  06/10/2011

Judge: First Suit Against Toyota to Trial in 2013. 

A federal judge has announced the first lawsuit against Toyota over allegedly defective cars will go to trial in California in 2013. The suit, filed in Utah over a fatal crash, claims the company made "defective cars that are responsible for the deaths" will serve as the "bellwether" case, and others are expected to follow. $100,000 Awarded to Students Hazed in Tennessee 

A Tennessee jury awarded $100,000 each to two local families in a lawsuit filed against the Wayne County school system over bullying at a local middle school. The lawsuit claimed that in 2008, two members of the boy's basketball team were sexually harassed and hazed in the school's locker room. The students found responsible for the hazing were sent to an alternative school for 11 days and put on probation with the school.  Brandon Gee, Tennessean  06/10/2011

The Consumer Product Safety Commission has announced the recall of 24,000 toy Military Copters, manufactured by Excite USA, due to a laceration risk. The agency said that the blades on the toy can come off during use and cause potential injury to the user. Small Number of iPad2 Tablets Recalled

Apple has announced it is recalling an "extremely small number" of iPad2 tablets on the Verizon network. The company reported that the recall was issued after it was discovered that the tablets had trouble connecting to the Verizon Wireless network. The tablets affected by the recall were manufactured with duplicate identifying numbers, which prevents them from connecting to the Verizon network.  Shan Li, LA Times  06/10/2011

Suit: Police Failed to Notice Woman was Still Alive

The estate of a Kentucky woman who was killed last year has filed a lawsuit against the city of Lexington over allegedly "reckless, wanton and egregious" police behavior during her murder investigation. The lawsuit claims that when police found her body in the bushes outside her apartment, she was still alive, but officers failed to notice for several hours. The suit claims officers did not check the body for vital signs upon arrival and did not realize the woman was alive until the body was taken to the Fayette County Coroner. Suit Blames Fire Department for Boys' Drownings

Two lawsuits have been filed against the Gwinnett County fire department in Georgia over the deaths of two teenage boys in January 2010. The boys drowned after falling through the ice on a frozen neighborhood pond. The suit says when firefighters arrived on scene, they waited for a boat to come instead of rescuing the boys immediately, who were alive at the time. While waiting for the boat, both boys drowned, the suit claims. The lawsuits are seeking $10 million each in damages.  David Wickert , Atlanta Journal-Constitution  06/10/2011

Atheist Group Files Suit over Arkansas Bus Ads

An atheist group in Arkansas has filed a lawsuit against the Central Arkansas Transit Authority over a series of ads the group is trying to run on city buses. The lawsuit claims the agency is charging the group tens of thousands of dollars to put $5,000 worth of ads on local buses. According to the suit, other groups, including churches, have not been required to pay the numerous fees the atheist group is being charged. 1,600 Yard Tractors Recalled 

The Consumer Product Safety Commission has announced a recall of 1,600 yard tractors manufactured by Husqvarna Professional Products Inc. The agency said the recall was initiated after it was discovered that the tractor's transaxle can experience intermittent drive failure which can lead to reduced braking ability. Bedford Laboratories Recalls Injection Vials

Bedford Laboratories has recalled a single lot of Indomethacin, used in injections, after it was discovered that the vials may contain "particulate matter." Cadillac SRX Vehicles Recalled 

General Motors has issued a recall of 47,000 2011 Cadillac SRX crossover vehicles to fix a problem with the passenger-side air bag. The company found that the head protection air bag may not inflate in a crash if the front seat is empty, potentially leaving any passengers in the back seat unprotected. Dad Files Suit over Video Defaming His Daughter

A Houston man has filed a lawsuit against three middle school girls in Kingwood after they posted a video on the Internet that shows them saying nasty and unkind words about his daughter. The defamation of character lawsuit claims the girls made false and derogatory statements about his daughter that "impute sexual impropriety and misconduct." Malpractice Suit Filed Against Jacksonville Hospital

A lawsuit has been filed against Memorial Hospital Jacksonville over the death of a 74-year-old woman in December of last year from sepsis. The suit claims her infection "spawned from drug-resistant staph, commonly called MRSA, [the plaintiff] picked up at the hospital." Suit: Baltimore Landlord Racist

A Baltimore family who owns a local bar filed a lawsuit against the company that owns the land their restaurant is on, claiming the company has racially discriminated against the family. The suit claims that as the bar's clientele become primarily African-American, the landlord company forced the bar out of business by "charging arbitrary rent amounts, turning off the lights in common areas, denying the restaurant use of a patio and [refusing] certain signage." Class-Action Suit Against Bayer Allowed 

The U.S. Supreme Court has ruled that the class-action lawsuit against Bayer may proceed. The suit, filed by a West Virgina couple, seeks to represent all West Virginians who took the cholesterol drug Baycol. Chrysler Recalls 11,000 Vehicles of Various Models

Chrysler has issued a recall of more than 11,000 vehicles manufactured this year due to problems with the steering column. The recall includes the 2011 model Jeep Wrangler, Liberty, Compass and Patriot, as well as the Dodge Journey, Avenger, Nitro and Caliber, and the Chrysler Town & Country. Mazda, Hyundai Recall Vehicles Made in China

Mazda has issued a recall of 94,874 Mazda 3 sedans in China to fix a problem with faulty windshield wipers on the vehicles, a Chines watchdog agency reported this week. The vehicles were manufactured at Mazda's three-party joint venture with Ford Motor and Chongqing Changan Automobile. All of us pay the price for this abuse, whether we realize it or not. Businesses forced to pay more for insurance and litigation have less to spend on innovation and job creation. And we pay a “tort tax†on everything we buy as rising insurance and litigation costs increase the price of goods and services.

It goes without saying that we need a strong court system to decide legitimate grievances. But the American court system virtually invites abuse by declining to punish people who misuse the system. Personal injury attorneys make billions suing government, our schools, hospitals, businesses and people without risk to their clients.
