I think the NCAA prevents any 6-6 team being selected over an available 7-5 team. A 7-5 ND team would be selected over all but the biggest of traditional schools though.

See therein lies the problem and as long as ND doesn't join a football conference, they are free from this NCAA rules which pertain only to conference selections.  The only rule ND "has" to comply with is 6 wins  Indedendent is not a conference (Navy, Army, ND).  Just because they are not aligned with a conference, they are not aligned together.
