San  Jose,  CA (Sports Network) -  San Francisco 49ers quarterback Jeff Garcia

was arrested early Wednesday morning due to suspicion of drunken driving.

The  three-time Pro  Bowl selection, who attended school at San Jose State and

still  lives  in the  area, was pulled  over near the  school's campus. He was

detained and booked around 3:30 a.m.

The San Jose State University Police Department will release a statement later

Wednesday to provide further detail.

The   33-year-old  signal  caller  is  coming  off  a  2003  season  where  he

completed 225-of-392 passes with 18 touchdowns and 13 interceptions. The 49ers

missed the playoffs and finished with a disappointing 7-9 record.

don't do criminal law

he is a free agent if i am not mistaken

if he doesn't check into rehab i wouldn't sign him

he should get jail time but he won't
