If he smells weed, that doesn't necessarily mean that the person is under the influence.

However, it does give probable cause to search the vehicle.  Some states with legal use, including medical, have removed this due to criticisms of alleged over-use.  Florida, is not one of those states.

So wait, you're saying it's possible someone lit up in the car, saw police lights, then threw it out? You can't do that. That's cheating.

It's like when someone fails a drug test at the NFL combine. It's an idiot test. It doesn't matter if you like the law or not. When I was in college, we had to sit through hours of drug/alcohol training (not to mention one on STDs where they showed us pictures of gonorrhea and explained what a "ream and scream" was to clean it up) and then they very explicitly explained that as student-athletes, we were not allowed to partake in illegal drugs. Our scholarship contracts were pretty clearly defined and if you failed a test, the punishment was suspension for X number of weeks. A second failed test was suspension for the remainder of the season. A third was revoking of the scholarship. It was politely explained that if we did not like the terms of the contract we were free to not sign them and move along. Now, that doesn't mean plenty of people didn't roll the dice on it or smoke their asses off all summer before testing resumed again, but in season, EVERYONE knew the risk. We lost our SS one year because he smoked. We didn't ***** about the law being unfair. We pretty much unanimously called him a selfish idiot. He pissed away part of our season.

Agreed but people are arguing different sides of dissimilar issues. If you don't like the laws there are multiple paths to address that. For me the argument is, whatever the law is FOLLOW it until it's changed.

This "I want to do what I want to do" mentality with complete disregard for how it impacts others is what pisses me off.

How, exactly, does the alleged crime "impact others", again?

Who does it help to put people in jail for having some pills? 

Prison execs. Big money in private prison systems.
